What is the difference between an “Occurrence” and “Claims-Made” form of professional liability?

Basically, occurrence coverage provides protection for professional liability services rendered while the policy is in effect, regardless of when a claim is filed. Even after the policy expires, the occurrence policy will still provide coverage for professional services provided during the policy term. With an occurrence policy, there is no need to purchase a “tail policy.”

Occurrence coverage is based on when an act occurred, claims-made coverage is based on when the act is reported, when the claim is actually made.

Claims made policies provide coverage for claims which are reported to the insurer while the policy is in force. The policy covers professional services rendered on or after (1) the policy inception date or (2) an earlier retroactive date. The retroactive date is a date mutually agreed upon by the company and the insured. Therefore, claims made policies may provide coverage for professional services rendered from a retroactive date through a cancellation or expiration of the current policy, o long as the claim is reported to the insurer during a policy period.

What is “tail coverage”?

Due to cancellation or non-renewal, an additional premium to purchase an Extended Reporting Endorsement, commonly called “tail coverage” may be required to provide protection for claims reported after the final claims-made policy’s termination date which provides coverage for cliaims filed in the future.

Meet Chuck WassonChuck Wasson Chartered Property & Casualty Underwriter and the Certified Insurance Counselors designations, both nationally recognized designations within the insurance industry.

Chuck Wasson, President, began working at Sandy Wasson & Associates Insurance in 1992. Prior to that he was an insurance adjuster and spent the last 30 days of his adjusting career in Miami following Hurricane Andrew. After entering the family agency, he began working with physicians which today accounts for the majority of the business at Wasson & Associates. He has a Bachelor of Science degree from the University of Florida and holds the Chartered Property & Casualty Underwriter and the Certified Insurance Counselors designations, both nationally recognized designations within the insurance industry.

Chuck is a past President of the Kiwanis Club of Pinellas Park is married and has two daughters. In his spare time, Chuck enjoys training and racing in Triathlons and completed Ironman Florida in 2004.
